Apex Works Inc. (“Apex Works,” “we,” “us,” or “our”) is a licensed California design-build construction company (EIN 392295194, CSLB #1144953) headquartered in Southern California. This Privacy Policy explains how we collect, use, and safeguard information when you interact with our website at meetapx.com, work with us on a construction project, or receive operational text messages from us in connection with tax reporting.

2. Information we collect

We collect only the information we need to run our business:

  • Contact information you provide through our website forms or during onboarding, including name, phone number, email address, and project details.
  • Tax and payment information from subcontractors, vendors, and personnel that we are required to collect for IRS reporting, such as W-9 details and amounts paid that appear on Form 1099-NEC.
  • Basic site analytics such as IP address, browser type, pages viewed, and referring URLs, collected through standard server logs.

3. How we use information

We use the information we collect to:

  • Respond to inquiries and provide construction services you have requested.
  • Send transactional text messages required to complete IRS tax-reporting workflows, including W-9 collection, 1099-NEC amount confirmations, and Copy B delivery.
  • Comply with legal, tax, licensing, and insurance obligations.
  • Maintain and secure our website and internal operational tools.

4. SMS / Text messaging

Apex Works sends a limited number of one-time transactional text messages to subcontractors, vendors, and personnel with whom we have an established business relationship. These messages contain tokenized, time-limited links used to complete or review W-9, 1099-NEC, and related IRS forms. Apex Works does not use SMS for marketing, promotional content, or bulk blasts.

Opt-in. Phone numbers are collected during onboarding, when a subcontractor or vendor provides their mobile number on a signed work agreement or vendor onboarding form and is informed that Apex Works may use it to deliver transactional tax-reporting notifications.

Opt-out. You can opt out at any time by replying STOP to any message. For help, reply HELP or contact us using the information below. Message and data rates may apply. Message frequency varies based on active tax-reporting workflows and is generally limited to a few messages per recipient per tax year.

No sharing of mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing is limited to subcontracted service providers that support the messaging program (for example, our SMS delivery vendor), which are contractually prohibited from using the information for their own purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. How we share information

We do not sell personal information. We share information only with:

  • Service providers that help us run the business (such as accounting, e-signature, and SMS-delivery vendors), under written confidentiality obligations.
  • Government agencies when required by law, including the IRS, California Franchise Tax Board, and California Contractors State License Board.
  • Parties you have directed us to share with, such as a general contractor or property owner on a project.

6. Data retention and security

We retain tax records for the period required by federal and California law, and operational records for as long as needed to run the project and meet our legal obligations. We use industry-standard technical and organizational safeguards, including encryption in transit, access controls, and audit logging on our internal portal.

7. Your choices and rights

California residents have rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know, delete, correct, and limit the use of personal information. To exercise a right, contact us using the information below. We may need to verify your identity before responding.

8. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will update the “Effective” date above and, for material changes, provide additional notice through our website.
